"Online Service" - the website at https://ukflightexperiences.com, any pages within, any automatic API or automated systems (such as the booking, pricing, availability or weather systems).
"Pilot" - the person fulfilling the role of 'pilot in command' of the aircraft for the duration of any UKFlightExperiences flight services or events as defined by the UK Air Navigation Order.
"Non-Commercial Flight" - a flight conducted in accordance with European Regulation (EU) No 379/2014 of 7th April 2014, amending Commission Regulation (EU) No 965/2012, which states that pilots are allowed to share flights as long as the aircraft does not exceed 6 seats and has a non-complex motorisation. The amount the pilot must contribute is not specified. The important thing is that the pilot must never profit.
"Booked Flight" - a confirmed booking of a Non-Commercial Flight made by a user and accepted by a Pilot.
"Passenger" - a person intending to be carried on board the aircraft during a Booked Flight.
By accessing the Online Service, purchasing any items from our online shop or attending in-person for any of our flight services or events (collectively, the "Service") you are agreeing to be bound by these Terms of Service (the "Terms"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these Terms, you are prohibited from using or accessing the Service. The information or software (collectively, "Content") contained within the Service is protected by applicable copyright and trademark law.
You must be at least 18 years old to use the Online Service. UKFlightExperiences ("Service Provider", "we", "us" or "our") may ask for identification or photographic copies of identification to be provided in order to verify the authenticity of transactions or interactions on the Online Service.
You represent that all information you provide to the Service upon registering, making a booking, amending or cancelling a booking, or in communication with us or your allocated pilot and at all other times will be true, accurate, current and complete, and you agree to update your information as necessary to maintain its truth and accuracy.
You may not use the Service for any illegal or unauthorised purpose.
You are solely responsible for your conduct and any actions triggered by you when using the Service.
You must not change, modify or alter another website so as to falsely imply that it is associated with the Service or the Service Provider.
You must not interfere with or disrupt the Service or servers or computer networks connected to the Service, including by making unnecessary or unreasonable requests to the Service, transmitting any worms, viruses, spyware, malware or any other code of a malicious or destructive nature. You must not inject code or modify Content that could change how a page is rendered or displayed in a user's browser or device.
You must not use any part of the Service or its Content through unauthorised means, including but not limited to, by using an automated device, bot, crawler or scraper.
Cancellations, postponements, requests to rearrange a Booked Flight, returns of items and late attendance are governed by our Cancellations and Refunds Policy unless otherwise specified in these Terms.
Violation of any of these Terms may, in the Service Provider's sole discretion, result in prohibition of access, cancellation of any orders, Booked Flights or appointments or further legal action.
The Service Provider and/or the Pilot have the right to cancel or rearrange any Booked Flight without notice at any time and for any reason. Neither the Service Provider nor the Pilot shall be liable for any travel, accommodation or any other expenses incurred from Booked Flight cancellations or postponement.
The user of the Service and any Passenger on a Booked Flight accepts that every flight offered by the Service Provider is a Non-Commercial Flight, which does not achieve the same safety standards as commercial aircraft operations, and the restrictions placed upon the Pilot to operate Non-Commercial Flights are less restrictive than those required for commercial operations, for example reduced licensing and medical requirements.
The Service Provider and/or the Pilot may refuse to accept a booking request for any reason.
The Service Provider and/or the Pilot may refuse entry to the aircraft or refuse carriage on a Booked Flight for any reason and at any time.
Passengers are responsible for ensuring that they are healthy enough to fly and if in doubt should seek medical advice before participating in a Booked Flight.
Passengers must ensure they are not under the influence of alcohol or drugs prior to attending a Booked Flight.
Passengers which are denied entry or carriage on a Booked Flight will not be refunded any amount paid.
Passengers are responsible for their conduct during a Booked Flight and must behave in a civilised manner. Passengers must not interfere with, manipulate or restrict any of the aircraft's systems or controls.
Passenger(s) over the age of 18 are responsible for the behaviour and conduct of any Passenger(s) under the age of 18, and of their compliance with these Terms.
Booked Flights which depart the aerodrome and are terminated early due to a breach or suspected breach of these Terms are entirely non-refundable.
If a Passenger is unsure whether their Booked Flight will be going ahead, they should contact their Pilot via text message or email more than 2 hours before their scheduled Booked Flight. Nil contact by the Pilot should be interpreted as the Booked Flight going ahead as planned.
Whilst every reasonable precaution is taken for the safety of Passengers and any accompanying spectators or observers, the Service Provider cannot be held liable for any loss, damage or injury.
Passengers wishing to take luggage or items on board the aircraft during a Booked Flight may only do so with the consent of the Pilot and entirely at their own risk.
The Service Provider does not guarantee availability of flights. Flights may be unavailable for long periods of time, for example due to weather, pilot or aircraft unavailability.
If a Passenger causes damage to any aircraft (including the one used on the Booked Flight or otherwise) they are primarily responsible for any damages or costs incurred by their actions. In the event that damages are caused and the Passenger involved refuses to pay what is owed, the person who originally made the booking (for whom we hold contact and address details) shall be held jointly liable.
It is possible that the aircraft undertaking a Booked Flight may have to divert to a different aerodrome at the sole discretion of the Pilot, for example due to weather or a mechanical problem. In this event, neither the Service Provider nor the Pilot will be held responsible for any costs incurred by the Passengers in returning to the aerodrome of departure or their places of residence, including any requirement for temporary accommodation.
It is also possible that the aircraft undertaking a Booked Flight will be unable to follow the planned route exactly and neither the Service Provider nor the Pilot can guarantee that each planned point of interest can be visited. For example, the weather conditions or a temporary airspace restriction may prevent access to localised areas. Passengers accept that they are not entitled to concessions or refunds if their flight plan cannot be fulfilled exactly and the cost of any flight time will be charged as usual.
Gift cards and electronic gift cards purchased from the Service Provider (collectively, "Gift Cards") are valid for 12 months from the date of purchase.
Gift Cards can be used in part or in full to book any of our sightseeing flights or to buy any items from our official online shop. If the cost of the flight or item exceeds the value of the Gift Card, the remaining balance must be paid in full at the time of purchase.
Gift Cards may not be re-sold under any circumstance. Only vouchers purchased directly from the Service Provider will be deemed valid and accepted.
Gift Cards cannot be exchanged for cash and no change will be given.
Gift Cards will not be replaced if lost, damaged or stolen.
The Video Production Service available in our online shop must be purchased in combination with a Booked Flight, and not by itself.
The purchaser of the Video Production Service accepts that such a video ("Video") may take up to three (3) working days after the respective Booked Flight has taken place to produce.
The Service Provider cannot guarantee that the Video or any of its Content will remain private, and the Service Provider has full rights to use any Video Content on its Online Service or social media platforms.
The Service Provider shall not be held liable if any virus, worm, spyware, malware or any other code of a malicious or destructive nature is transferred to you or any of your devices while attempting to download, view or otherwise engage with the Video or any of its Content.
a. Permission is granted to temporarily download one copy of the Content from the Online Service for transitory viewing only. This is the grant of a licence, not a transfer of title, and under this licence you may not:
b. This licence shall automatically terminate if you violate any of these restrictions and may be terminated by the Service Provider at any time. Upon termination of your licence, you must destroy any downloaded Content in your possession whether in electronic or printed format.
The Service Provider reserves the right to refuse access to the Service to anyone for any reason at any time.
The Service Provider does not claim ownership of any information that you provide to the Service. Instead, you hereby grant the Service Provider a non-exclusive, fully paid and royalty-free, transferable, sub-licensable, worldwide licence to use the information that you provide to the Service, subject to the Service's Privacy Policy.
The Service name and logo are trademarks of the Service Provider, and may not be copied, imitated or used, in whole or in part, without the prior written permission of the Service Provider.
The Content is provided by the Service on an 'as-is' basis. The Service Provider makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, the Service Provider does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the Content on its Service or otherwise relating to such Content or on any sites linked to this site.
In no event shall the Service Provider or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use of, or inability to use the Service or its Content, even if the Service Provider or an authorised representative of the Service Provider has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
The Content appearing on the Service could include technical, typographical or photographic errors. The Service Provider does not warrant that any of the Content on its website is accurate, complete or current. The Service Provider may make changes to the Content contained on its Service at any time and without notice. However, the Service Provider does not make any commitment to update the Content.
The Service Provider has not reviewed all of the websites linked to its Service and is not responsible for the contents of any such site. The inclusion of any link does not imply endorsement by the Service Provider of the site. Use of any such linked website is at the user's own risk.
The Service Provider may revise these Terms for its Service at any time and without notice. By using the Service you are agreeing to be bound by the then current version of these Terms.
These Terms are governed by and construed in accordance with the laws of the United Kingdom and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
